Apply for entry in the professional register for tax advisors
Source: Serviceportal Rheinland-PfalzThe professional register for tax consultants is kept by the relevant Chamber of Tax Consultants. Entries in the professional register are made by the responsible Chamber of Tax Consultants.
The Rhineland-Palatinate Chamber of Tax Consultants is responsible for tax consultants, tax agents and professional practice companies with a professional establishment in Rhineland-Palatinate.
If tax advisors or tax agents are appointed in the district of the competent Chamber of Tax Advisors (register district) or relocate their professional establishment to this district, they are entered in the professional register for tax advisors.
The following must be entered for tax advisors and tax agents
a) the surname, first name or first names, date of birth and place of birth of the tax adviser or tax agent,
b) the date of appointment and the authority or chamber of tax advisors that made the appointment
c) the authorization to use the designation "Landwirtschaftliche Buchstelle" and the designations in accordance with the Fachberaterordnung,
d) the address of the professional establishment, the telecommunications data, including the business e-mail address, and the business Internet address,
e) professional associations within the meaning of §§ 49, 50 and 55h StBerG,
f) the address of the other advisory offices, the surname, first name or first names and the address of the persons managing the other advisory offices,
g) the surname, first name or first names and address of the representative or authorized agent, if one has been appointed or nominated
h) the existence of a professional or representation ban within the meaning of Section 90(1)(4) or Section 134,
i) the designation of the special electronic tax advisor mailbox and
j) all changes to the information in letters a and c to i;
For professional practice companies, the following must be entered
a) the name or company name and the legal form,
b) the date of recognition as a professional practice company and the name of the authority or chamber of tax advisors that granted the recognition,
c) the authorization to use the designation "Landwirtschaftliche Buchstelle",
d) the address of the professional establishment, the telecommunications data, including the business e-mail address, and the business Internet address,
e) professional associations within the meaning of §§ 49, 50 and 55h StBerG,
f) the following information on the shareholders:
aa. in the case of natural persons: the surname, first name or first names and the profession practiced in the professional association,
bb. in the case of legal entities and partnerships with legal capacity: their name or legal form, their registered office and, if provided for by law, the register responsible for them and the register number,
g) in the case of legal entities: the surname, first name or first names and profession of each member of the body appointed to legally represent them,
h) in the case of partnerships with legal capacity: the partners authorized to represent the company and their profession,
i) the surname, first name or first names and profession of the employed tax consultants, tax agents, lawyers, auditors and sworn accountants who are authorized to represent the professional practice company, provided that the professional practice company applies for entry in the professional register,
j) the address of the other advisory offices, the surname, first name or first names and the address of the persons managing the other advisory offices,
k) the surname, first name or first names and address of the representative or authorized agent, if one has been appointed or designated,
l) in the case of recognized professional practice companies: the existence of a professional or representation ban within the meaning of Section 90 (2) no. 4 or Section 134,
m) the name of the special electronic tax consultant mailbox of the professional practice company and
n) all changes to the information in letters a and c to m.
For further advisory offices of tax advisors and tax agents, if they are established in the register district:
(a) the surname, first name or first names and address of the tax adviser or tax agent,
b) the authorization to use the designation "Landwirtschaftliche Buchstelle",
c) the address of the other advisory offices,
d) the surname, first name or first names and address of the persons managing the other advisory offices, and
e) any changes to the information in letters a to d.
For further advice centres of recognized professional practice companies, if they are established in the registration district:
a) the name or company name and the legal form,
b) the authorization to use the designation "Landwirtschaftliche Buchstelle",
c) the address of the other advisory offices
d) the surname, first name or first names and address of the persons managing the other advisory offices, and
e) all changes to the information in letters a to d.
Note: Not only transfers to a specific register district are subject to notification, but also transfers from a register district. This must be reported to the competent Chamber of Tax Consultants in that district.
In principle, an informal notification is sufficient.
There are no fees
Notifications of entries in the professional register must be made without delay. Timely notification ensures that the professional register kept by the Rhineland-Palatinate Chamber of Tax Consultants is always up to date.
Processing Time: 2 - 4 Days
The Federal Chamber of Tax Consultants (BStBK) maintains an electronic directory of all members of the chambers of tax consultants in accordance with the Tax Consultancy Act. This directory of tax advisors is used to provide information to authorities and courts, persons seeking legal advice and other parties involved in legal transactions. The chambers of tax advisors enter the data stored in the professional register into the directory maintained by the Federal Chamber of Tax Advisors using an automated procedure. Anyone is entitled to retrieve individual data from the register free of charge.
A citizen can use the register of tax advisors to check whether a particular person/company has been appointed as a tax advisor or tax agent or is recognized as a professional practice and is therefore authorized to provide unrestricted assistance in tax matters.
The tax consultant directory, on the other hand, is not used to search for a tax consultant for a specific specialist area or with special qualifications. The nationwide tax consultant search service of the Federal Chamber of Tax Consultants and the chambers of tax consultants is available for this purpose.
