According to Section 64 (1) of the Rhineland-Palatinate State Building Code (LBauO), construction documents for the construction and alteration of buildings requiring approval and for projects for which the exemption procedure is carried out in accordance with Section 67 LBauO must be the responsibility of an authorized designer. This does not apply to the projects listed in Section 64 (1) sentence 2 LBauO.

A person authorized to submit building proposals pursuant to Section 64 (2) LBauO is

  1. anyone who is entitled to use the professional title of architect under the Architects Act,
  2. anyone who is entered in a list maintained by the Rhineland-Palatinate Chamber of Engineers; anyone who meets the requirements set out in Section 64a LBauO must be entered in the list upon request,
  3. anyone who is entitled to use the professional title of interior designer under the Architects Act for the structural alteration of buildings associated with the professional task of interior designer,
  4. anyone who is an employee of a legal entity under public law and can provide evidence of a professionally qualifying university degree in the field of civil engineering in accordance with the guidelines set out in the annex or in the field of architecture and who has subsequently been practically active in the field of design planning for buildings for at least two years as part of their official duties.

Authorized to submit building designs for

  1. Residential buildings of building classes 1 and 2 with a maximum of two apartments up to a total floor area of 100 m² and
  2. commercial, agricultural and forestry buildings with no more than one storey above ground and up to 250 m² floor area

The following persons are also registered in the list of persons with limited authorization to submit building plans at the Rhineland-Palatinate Chamber of Architects or the Rhineland-Palatinate Chamber of Engineers in accordance with Section 64 (3) LBauO:

  1. Professionals who have a domestic or foreign university degree in architecture or civil engineering,
  2. state-certified technicians specializing in civil engineering,
  3. Persons who have passed the master craftsman's examination in the bricklaying, concrete construction or carpentry trades and are entered in the register of craftsmen, have worked as a master craftsman for two years and can present a course of at least 60 hours of construction planning content recognized by the Rhineland-Palatinate Chamber of Architects or the Rhineland-Palatinate Chamber of Engineers to supplement their master craftsman training. The granting of a license to practice in accordance with Sections 7a and 7b of the Crafts Code in the version dated 24 September 1998 (BGBl. I p. 3074; 2006 p. 2095) in the currently valid version is not sufficient for this.

Sections 64b to d of the LBauO contain regulations on the authorization of persons from other member states of the European Union or a country treated as such under European Community law to submit building plans.
