Waste may only be treated, stored or deposited in plants or facilities authorized for this purpose (waste disposal plant). These can be, for example, waste sorting plants, waste handling plants, composting plants, waste incineration plants, waste storage facilities or landfills.

These facilities are of particular environmental relevance. They may only be built and operated if a permit has been issued in accordance with the Federal Immission Control Act (BImSchG). The annex under number 8 of the "Ordinance on Installations Requiring a Permit - 4th BImSchV" conclusively defines the installations to which this applies. In contrast, the construction and operation of landfills requires approval under waste legislation, usually a planning approval procedure. All other waste disposal facilities only require a building permit.

The implementation of approval procedures in accordance with the Federal Immission Control Act is described in the "Procedural Manual for the Implementation of the Federal Immission Control Act - Implementation of Approval Procedures". The procedure manual describes the course of the procedure, offers assistance in questions of procedure management and serves as a source of information for specific procedural questions.

It is generally advisable for the applicant to contact the competent licensing authority as early as possible. Even before submitting the application documents, the applicant should take advantage of the offer of consultations to clarify in advance the type and scope of the documents, the course of the approval procedure, the legal basis and questions specific to the individual case. This can considerably speed up the approval procedure.
