Maternity protection Exception to dismissal protection
Source: BUS Rheinland-PfalzThe dismissal of a woman during pregnancy and until the expiry of four months after delivery is in principle inadmissible if the employer was aware of the pregnancy or delivery at the time of the dismissal or is notified within two weeks of receipt of the dismissal; exceeding the deadline is harmless if it is based on a reason for which the woman is not responsible and the notification is made up immediately.
In special cases, the competent authority may, exceptionally, declare the dismissal admissible. The dismissal given by the employer must be in writing, the dismissal must contain the permissible reason for dismissal.
