You then have the option of choosing the gender entry male, female or diverse, or leaving the gender entry open in the register.
Please contact the registry office of the municipal or city administration that keeps your birth register.
However, you can also contact the registry office of your place of residence. In this case, the declaration will be recorded there and sent to the registry office of the birth, from which you can then receive a new birth certificate.
If your birth is not recorded in a German birth register, the registry office that maintains your marriage or civil partnership register is responsible. If there is no jurisdiction thereafter, the registry office of your domicile or the last domicile or habitual residence is competent. If there is no jurisdiction after that, the registry office I in Berlin is responsible.
Here's what you need to keep in mind:
- The change of gender entry and first names can only be carried out for Germans within the meaning of the Basic Law, as well as for stateless persons, homeless foreigners, foreign refugees or persons entitled to asylum.
- A medical certificate confirming a variant of sex development for biological reasons (intersexuality) must be presented; this means that you cannot be biologically assigned to either the female or the male sex.
- The medical certificate may be replaced by an affidavit of the person concerned if they do not have a medical certificate of medical treatment and if, as a result of the treatment, the presence of a variant of sex development can no longer be proven or can only be proven by an unreasonable examination.
- For a legally incompetent person and a child under 14 years of age, the application can only be made by the legal representative; a person with limited legal capacity requires the consent of the legal representative.
- This option is not available for transsexual people. The change of name and gender entry for this group of persons is governed by the Transsexual Act.
