Paying recurring contributions for traffic facilities
Source: Serviceportal Rheinland-PfalzMunicipalities levy recurring contributions for the expansion of public roads, paths and squares (traffic facilities). Expansion includes all measures on facilities or installations created for the first time that serve to renew, expand, convert or improve them.
However, you as the property owner only bear part of the costs caused by municipal roads by paying the development contributions. The necessary maintenance and repair measures are borne by the municipality alone. The municipality has to bear its own share of the contributory development measures, the so-called "municipal share". This is between 20 and 75 percent. It is determined by the volume of through traffic in relation to the total traffic volume in the respective road or billing unit.
The remaining part of the annual costs for the expansion of traffic facilities in a settlement unit is allocated to all property owners in the relevant settlement unit when recurring road expansion contributions are levied. Settlement units can be the entire municipal area or parts of it. This depends on the size and structure of the respective municipality.
Municipal traffic facilities, i.e. roads, paths, squares, parking lots and green spaces, not only have to be built and maintained, but sometimes also extended or even renewed. To cover the resulting costs, financial contributions must be levied in accordance with the German Municipal Charges Act (KAG).
Municipalities can levyroad improvement contributions in accordance with the statutory provisions of the KAG on the basis of their own bylaws if traffic facilities are to be renewed, extended, rebuilt or improved.
One-off contributions
In Bad Neuenahr-Ahrweiler, one-off development contributions are levied for the development of a single traffic facility, e.g. a specific road
Recurring contributions
On 29.04.2020, the state parliament decided to introduce recurring road improvement contributions throughout Rhineland-Palatinate by 01.01.2024 at the latest. As a result, from a date yet to be determined by municipal statutes, road improvement contributions in Bad Neuenahr-Ahrweiler will no longer be collected in the form of one-off contributions but as recurring contributions.
For each measure, the town will contribute to the costs of road development to the extent that corresponds to the degree of use of the respective traffic facility by the general public (municipal share).
Irrespective of the actual use, the obligation to contribute applies to all properties that are actually and legitimately accessible via the respective traffic facility.
The entitlement to a one-off road improvement contribution arises upon completion of the construction work on the respective traffic facility. Advance payments can be made from the start of the construction work.
Recurring road improvement contributions must be paid by December 31 for the previous year, although appropriate advance payments may be requested during the current year.
