The construction, modification, change of use and demolition of structural installations (e.g. buildings) require planning permission. However, this only applies if the Rhineland-Palatinate state building regulations do not stipulate otherwise, such as in the catalog of projects that do not require a building permit, in the exemption procedure and projects that are not subject to building supervision.

A building permit must be granted if the project does not conflict with any building or other public law regulations. The application for a building permit (building application) must be submitted to the municipal administration or the association municipal administration.

Which building documents must be submitted with the building application is determined in particular by the state ordinance on building documents and the building inspection. The building application and the building documents must be signed by the client and the author of the design, who is authorized to submit building designs for building applications.

The building permit is valid for four years. This period can be extended upon application. The application must be received before the deadline expires.

Special information for Administrative District Mayen-Koblenz

Application procedure

The developer submits his documents to the local building authority of the association municipality or the town of Bendorf.
There it is checked whether the development is secured and whether sufficient parking spaces are available. The association municipalities also obtain the consent of the local municipality in whose area the building plot is located. They then forward the application to the district building authority. There it is registered and given a file number, which is communicated to the building owner in a confirmation of receipt and which should always be quoted when contacting the building authority. The staff at the district building authority will check whether the project complies with building planning regulations and - depending on the type of procedure - also building regulations. If documents are missing, they will be requested from the client. Only when all documents are complete can the district building authority request the opinions of the specialist authorities. Depending on the type and location of the construction project, these may be, for example, the water authority, the trade supervisory authority, the nature conservation authority, the state mobility authority or the monument protection authority. These specialist authorities must check within one month whether they have any objections to the project or require any conditions and inform the building authority accordingly.
If no serious objections to the construction project have been raised and there are no problems under building law, the building authority will issue the building permit.

Necessary documents

There is a nationally standardized building application form, which must be accompanied by all the documents required by the authorities involved in the approval process. The building application must be submitted in triplicate for private construction projects and at least in quadruplicate for commercial projects.

It is the responsibility of the commissioned planner to submit complete and verifiable documents. Further information can be found in the "Landesverordnung über Bauunterlagen und die bautechnische Prüfung" (BauUntPrüfVO).

The application for a building permit must include at least the following documents:

Site plan
The site plan can be obtained from the Surveying and Cadastre Office Osteifel-Hunsrück in Mayen. It is issued on the basis of an official cadastral map, at least on a scale of 1 : 1,000. The uncertified original issued and additional copies for the additional copies of the application must be submitted.
If there are other structures within a radius of approx. 50 m that are not included in the site plan of the land registry office, these must be added by the planner. The site plan should include

  • the building project, stating the external dimensions, the roof shape, the height of the first floor in relation to the public traffic area, the boundary distances, the depth and width of the clearance areas and the distances to other structures on the same property
  • the position of the property in relation to the north
  • the distances between the planned building structure and nearby public traffic areas, green spaces or water areas, forests
  • the location and size of access roads, parking spaces, playgrounds for small children
  • existing buildings on the property and on neighboring properties
  • cultural and natural monuments as well as trees and shrubs to be preserved

General site plan
The general site plan is required if the planned project is not located in a development plan area but, for example, in an outdoor area or on the edge of a village and nature conservation regulations must be observed. The general site plan is a topographical map of Rhineland-Palatinate on a scale of 1: 25,000, in which the location of the planned building is entered.

Construction drawings
A scale of 1 : 100 is to be used for the construction drawings. The plans must contain all the information that is important for an assessment. For this purpose, the planner draws all levels as floor plans with dimensions, views and important sections. For the representation of the terrain, terrain profiles from the center of the street to the rear boundary must be entered in the elevation drawings, as well as the terrain from the right to the left boundary.
In the case of conversions, extensions, etc., the respective components must be marked as demolition, existing and new construction.

Building description and calculations
The planned project must be explained in the building description, particularly with regard to its construction and use, if this is necessary for the assessment and the necessary information cannot be included in the site plan and the construction drawings. There is also a standardized national form for the building description. The building application also includes verifiable calculations of the built-up area, the floor area ratio, the floor area ratio, the shell and total costs, the enclosed space, a living space calculation and the calculation of the required clearance areas. In addition, the proof of stability (statics), the thermal and, if applicable, the sound insulation proof must be provided.

Drainage documents
The systems for the disposal of wastewater and rainwater are shown on the site plan and in floor plans of the individual building levels. There are also sectional views of the ground and connection pipes. Small sewage treatment plants, pits and soakaways must be shown in special drawings.

Statistical survey form
A statistical survey form (available from the district building authority or the planner) must be submitted to the state statistics office in Bad Ems whenever a residential building is to be constructed or altered. In all other cases, the information is only required if the building project has a volume of more than 350 m³ or the estimated costs exceed EUR 18,000.

Description of operations
For all commercial construction projects, a detailed description of the operation with information on the activity of the business, operating procedures, operating hours, machinery and number of employees must be enclosed.

Application for exemption/deviation
If exemptions or exceptions to the development plan or deviations from building regulations are required, these should be applied for in writing with reasons and, if applicable, a proposal for alternative measures. The prescribed form, which is included in the building application form, should be used. If neighbor-protecting regulations are affected, the construction drawings and the site plan must be signed by all owners of the affected properties.

Neighbor participation

It makes sense to inform your neighbors about the planned building project in good time. No neighbor can deny a builder the right to build on his own property in accordance with the prescribed framework conditions. On the contrary: if the project complies with all building regulations and other public law provisions, the developer is even entitled to approval, even if the neighbor has something against it. However, if the builder comes into conflict with regulations that serve to protect the neighbors, the builder must submit the site plan and the construction drawings to the neighbors for signature.
