Preservation of monuments
Source: BUS Rheinland-PfalzThe preservation of monuments is divided, among other things, into the preservation of monuments. It deals with the preservation and sustainable handling of our built environment, as far as these are cultural monuments.
These can be example:
- Architectural monuments,
- Monument areas,
- archaeological cultural monuments,
- archaeological monuments,
- movable cultural monuments
- Small monuments.
If you intend to carry out reconstruction work on your monument, or if a building monument has to be removed for compelling reasons, please contact the competent authority in good time.
The first point of contact for applications for changes or other measures on cultural monuments is usually the lower monument protection authority, which is located in the district administrations and the administrations of the district-free cities.
The heritage authority is responsible for certificates (including certificates for presentation to the tax office) as well as the preparation of expert opinions on questions of monument protection.

Cultural monuments are objects from a bygone era that
- testimonies, in particular of intellectual or artistic creation, craftsmanship or technical work or historical events and developments,
- traces or remains of human life or distinctive features of towns and cities and
- there is a public interest in its preservation and maintenance or its scientific research and documentation for historical, scientific, artistic or urban reasons.
The application for listed building approval must be made in writing, accompanied by relevant documents, and submitted to the Lower Monument Protection Authority.
The following documents must be enclosed with the application:
-current official cadastral plan
-photographs
-cost estimates
Depending on the scope and type of measure, further documents may be required, for example
-documentation (e.g. damage analyses, room books, etc.)
as-built plans (floor plans, views, sections)
-expert opinions
-Cost and profitability calculations
-Design plans
The decision on the application for listed building approval is made by the Lower Monument Protection Authority in consultation with the specialist authority for listed buildings (GDKE). The specialist authority receives the application documents for this purpose. If necessary, a joint site visit takes place.
The aim of monument preservation is to replace as little as possible of the original, historical substance and to preserve as much as possible. In order to ensure that the "old" building materials are compatible with the "new" building materials, only materials that are compatible with listed buildings should be used when renovating. In individual cases, this can even help to save costs. It is therefore essential to check the extent to which existing historical substance is still present and worth preserving or where it is advisable to replace it, for example due to weather-related damage.
What fees are charged?
Official acts of the monument protection authorities and the monument authority
are, in contrast to official acts under building law, free of state-regulated fees. This does not apply to orders issued by the lower monument protection authorities in accordance with Section 14 (1) and (2) or to the preparation of expert opinions and the issuing of certificates by the monument protection authority in accordance with Section 25 (1) sentence 2.
When preserving and repairing your monument, you can receive financial support through tax breaks and public subsidies.
Tax certificate
Tax concessions in relation to the monument status are only granted if the measures are carried out in accordance with this monument permit and in prior consultation with the monument authority of the General Directorate for Cultural Heritage (GDKE). The GDKE issues basic notices for the tax office after successful completion of the work. The required prior coordination with the GDKE regarding the tax certificate is not replaced by the present approval under monument law.
After completion, meaningful photos must be submitted to the Lower Monument Protection Authority in order for the tax certificate to be issued by the State Monument Protection Authority. These can be sent by e-mail.
