Catering industry, apply for permission on special occasions
Source: BUS Rheinland-PfalzIf you would like to operate a restaurant with alcohol serving as part of a temporary event (e.g. funfair, city festival, shooting festival) or for another temporary occasion (e.g. canteen on the occasion of a major construction site), you can apply for a temporary permit (permit) under simplified conditions. Permission is revoked.
Permission is also required if you have a travel trade card. Conversely, you do not need a travel trade card for a specific event if you already have a permit to do so (§ 55a para. 1 no.7 GewO).
If you want to regularly participate in a certain recurring event with your catering business (e.g. at an annual folk festival), there is basically an alternative to repeatedly applying for a permit. If there is no change in the spatial conditions or the mode of operation of your business, a permanent permit can be considered. However, the granting of such a permit does not say anything about the allocation of a stand at the respective event.
Since a permit is granted only for the duration of a specific event, i.e. for a limited period of time, it is subject to less stringent conditions than the granting of a permanent restaurant permit.
For every event at which food and drinks are served, the organizer requires a temporary permit in accordance with the Hospitality Act. The permit is only dispensable if no alcoholic beverages are served.
The application for a permit must be submitted at least 14 days before the event.
Prohibitions under the Hospitality Act:
Alcoholic beverages may not be served at flat-rate or reduced prices. The organization of so-called "flat-rate", "coma" or "1-euro parties" is therefore not permitted.
Serving drinks, serving food:
If the serving of alcoholic drinks is permitted, non-alcoholic drinks must also be served on request. At least one of these non-alcoholic drinks must not be more expensive than the cheapest alcoholic drink in the same quantity.
If drinking vessels are used several times, a hygienic rinsing device with a fresh water supply must be provided.
The provisions of food law must always be complied with. You will receive a mark sheet from the Cochem-Zell district administration together with the permit.
Protection of minors:
The organizer must familiarize himself with the provisions of the Youth Protection Act and display the relevant excerpts from the Youth Protection Act in a conspicuous, clearly visible and legible manner. Alcohol may not be supplied to children and young people under the age of 16 and they may not be permitted to consume it. A corresponding notice of the youth protection regulations will be attached to the permit.
Closing time:
The closing time for pubs, restaurants and public entertainment venues begins at 5.00 am and ends at 6.00 am. The closing time is lifted on Saturday nights, Sundays, public holidays, Shrove Monday and Shrove Tuesday.
Immission control (noise):
Residents must not be disturbed by noise. The regulations of the State Immission Control Act must be strictly observed. From 10.00 p.m. to 6.00 a.m., the State Immission Control Act prohibits any activities that could lead to a disturbance of the night's rest. This applies in particular to the volume of music performances. It should be noted that the organizer is also responsible for the conduct of its guests outside the event room. This also applies to the noise generated by visitors arriving at and departing from the event.
Marquees / marquee approval:
Operation in a marquee measuring 75 m2 or more may only commence once the marquee has been approved by the Cochem-Zell District Administration, Lower Building Supervisory Authority. An acceptance date must be agreed with the building inspectorate (Mr. Peters, Tel. 02671/61-866).
Toilets:
Guests must be provided with hygienic toilets - for larger events: Toilet vans - with hand-washing facilities must be made available to guests. Disposable soap and paper towels must always be provided for guests at the hand wash basins. The use of solid, so-called toilet soap and communal towels is not permitted for reasons of hygiene. Any temporary toilets must be indicated by appropriate signs in the event room and at the entrances and exits.
Contact person during the event:
The organizer must designate a responsible person for the entire duration of the event, whose availability must be ensured at all times
Security service:
The organizer must deploy a sufficient number (at least 1 steward per 100 visitors) of adult stewards. If the number of visitors is expected to exceed 1,000, a professional security company must be commissioned to provide security services. However, depending on the event, the commissioning of a security company can also be ordered for events with fewer than 1,000 visitors.
