Applying for planning permission for the construction of an installation
Source: Serviceportal Rheinland-PfalzThe construction, modification, change of use and demolition of structural installations (e.g. buildings) require planning permission. However, this only applies if the Rhineland-Palatinate state building regulations do not stipulate otherwise, such as in the catalog of projects that do not require a building permit, in the exemption procedure and projects that are not subject to building supervision.
A building permit must be granted if the project does not conflict with any building or other public law regulations. The application for a building permit (building application) must be submitted to the municipal administration or the association municipal administration.
Which building documents must be submitted with the building application is determined in particular by the state ordinance on building documents and the building inspection. The building application and the building documents must be signed by the client and the author of the design, who is authorized to submit building designs for building applications.
The building permit is valid for four years. This period can be extended upon application. The application must be received before the deadline expires.
The application for a building permit (building application) must be submitted by the client to the building supervisory authority.All documents required for the assessment of the project and the processing of the application (building documents) must be submitted with the building application. It may be permitted for individual construction documents to be submitted subsequently. The building supervisory authority forwards the building application to the municipal administration without delay and, if necessary, requests the consent or approval of the municipality in accordance with the German Building Code, which will comment on the project without delay.
The lower building supervisory authority is responsible for issuing the building permit. This is the district administration, in independent and large towns belonging to the district, the municipal administration or the association municipality administration if it has been assigned building supervision tasks (Diez and Konz association municipality administrations).
The construction documents must be prepared by drafters who have sufficient expertise and experience.Construction documents for the construction and alteration of buildings requiring approval must always be prepared by a drafter who is authorized to prepare construction documents.
The necessary building documents are regulated in the state ordinance on building documents and the building inspection (BauuntPrüfVO). According to § 1 BauuntPrüfVO, the following building documents must be enclosed with the building application:
1. the site plan (§ 2),
2. the construction drawings (§ 3),
3. the building description (§ 4),
4. the structural engineering certificates (§ 5),
5. the description of the site drainage (§ 6),
6. in the case of building projects in outdoor areas, an extract from the official topographical map at a scale of 1:25,000 with identification of the property to be built on.
The scope, content and number of the construction documents depend on the respective project. The construction documents must contain details of all design authors. In addition to the numerical indication of the scale for calibration, the site plan and each construction drawing must also include a graphic scale bar, unless existing scale chains enable calibration. This must be labeled with the actual distances. The building supervisory authority can dispense with individual construction documents or details in construction documents if these are not required to assess the project. It may request further construction documents as well as diagrams, photographs or models if these are required to assess the project.
If other official decisions are required in addition to the building permit (e.g. listed building permits, water or nature conservation decisions), the necessary documents must be submitted together with the application for approval.
Fees are incurred for the granting of planning permission, the amount of which is essentially determined by the type of project approved. These fees are charged in accordance with the State Ordinance on Fees and Remuneration for Official Acts and Services under Building Regulations Law (Special Fee Schedule).
Upon receipt of the building application, the building supervisory authority must check within 15 working days whether
- the building application and the building documents are complete,
- other authorities or bodies are involved and
- other authorities or bodies and whether
are involved. If the building application is incomplete or otherwise has significant deficiencies, the building supervisory authority shall request the client to rectify the deficiencies within a reasonable period of time. If the defects are not rectified within the deadline, the application is deemed to be withdrawn.

Objection and subsequent legal action in accordance with the Administrative Court Code (VwGO).
The application for a building permit must be submitted to the lower building supervisory authority.
