Sunday open for sale
Source: BUS Rheinland-PfalzIn order to ensure the Sunday and holiday rest and the rest of the sales staff, sales outlets are generally closed on Sundays and public holidays. Per year, a maximum of four general Sundays open for sale per municipality may be released by ordinance. There is no entitlement to the release of Sundays open for sale vis-à-vis the municipality. The permitted opening hours may not exceed five hours; it must not be between 6 and 11 o'clock.
Contact the regulatory authorities (Ordnungsämter) of the non-affiliated municipalities, association municipalities, district-free and large district-affiliated cities.
An application must be submitted showing who the organizer is, e.B. advertising association of the city XY, when the Sunday open for sale should be and in which district it should take place.
There are no fees.
Since a hearing procedure is required, the application should be received by the authority about six weeks before the planned Sunday open for sale.
It is necessary that the municipalities, as legislators, make a sufficient balance between the need to regulate the release of the Sunday open for sale and the protected goods of the Sunday before taking a decision on the release of a Sunday open for sale. This balancing decision must be attached as a justification to the draft of the RVO at the consultation of trade unions, employers' and business associations, churches and other relevant institutions.
It should be noted that for reasons of holiday protection, no holidays can be released. The Shop Opening Act also stipulates that no sales outlets may be allowed to be kept open on Easter Sunday, Pentecost Sunday, National Day of Mourning, Sunday of the Dead, Advent Sundays in December and Sundays on which a public holiday falls.
The release of the 1st Sunday of Advent in November is possible. No "consecutive" Sundays may be released. The respective release can be seen in a community-specific manner.
