Requesting access to the register of building encumbrances

Inspections are usually carried out by appointment with the building supervisory authority. Information can be requested from the building supervisory authority.

Contact the lower building supervisory authority. This is the district administration, in independent and large towns belonging to the district, the municipal administration or the association municipality administration if building supervision tasks have been transferred to it (Diez and Konz association municipality administrations).

The legitimate interest in the inspection or information must be justified to the building supervisory authority.

Depending on the individual case, the legitimate interest in the inspection or information must be proven to the building supervisory authority.

Written information from the register of building encumbrances is subject to a fee. The amount of the fee is set out in the State Ordinance on Fees and Remuneration for Official Acts and Services under Building Regulations Law (Special List of Fees).

As a rule, disputes in connection with building encumbrances are subject to administrative law (objection and subsequent legal action).

There is no nationally introduced form. Where applicable, the locally responsible lower building supervisory authorities have developed forms to assist with the application.
