Exercising the municipality's right of first refusal
Source: Serviceportal Rheinland-PfalzExercise of the right of first refusal means that when a municipality purchases a plot of land in its municipal area, it has a right, subject to certain conditions, for it or a third party to enter into the purchase agreement and subsequently become the owner of the land. The right of first refusal may only be exercised if the public good justifies it.
The exercise of the right of first refusal may be excluded under certain circumstances or may be averted by the purchaser.

According to Section 28 (2) sentence 1 BauGB, the municipality's statutory right of first refusal can only be exercised by administrative act against the seller within three months of notification of the purchase agreement.
