Ordering a safety-related assessment requiring monitoring

The employer must make an accident or damage report. This is possible in writing or online. The authority may then order a safety-related inspection by an approved inspection body. This is to be carried out by the employer at his own expense.

Responsibility lies with the Structure and Approval Directorate North (northern Rhineland-Palatinate), the Structure and Approval Directorate South (southern Rhineland-Palatinate) or the Department of Trade Supervision insofar as they are not mining establishments.

There must be a notifiable event in connection with an installation requiring monitoring, in the case of a

1. an accident in which a person has been killed or seriously injured, or a
2. Damage in which components or safety equipment have failed.

The Authority considers it necessary to carry out an inspection by a specific Approved Monitoring Body.

Depending on the effort, this can be between 50.00 and 320.00 euros.

If, following a serious accident, the authority recognises the need for a safety inspection, it will immediately order such a test and set a deadline for its implementation. There are no legal deadlines.

An order is issued approximately 1-2 weeks after the authority becomes aware of the circumstances relevant to the decision, which enables the decision on a necessary examination. A possible objection is usually processed within 4 weeks.
