War victims' welfare benefits for surviving dependants

Source: BUS Rheinland-Pfalz

Surviving dependants who are granted (or are likely to be granted) benefits under the Federal Pension Act or in corresponding application of this Act, e.g. under the Soldiers' Pension Act, the Civilian Service Act, the Prisoners' Relief Act, the Protection against Infection Act or the Act on Compensation for Victims of Violent Crimes or the Criminal Rehabilitation Act, may also receive assistance under the War Victims' Welfare Act.

The prerequisite is that the survivors are not in a position to cover the need to be recognized from the other benefits under the aforementioned laws and other income and assets due to the loss of a spouse, parent, child or grandchild. Whether and to what extent income is to be taken into account depends on different and individual income limits. However, the use of income and assets can be waived in certain cases.

In addition to personal assistance, benefits in kind, one-off and ongoing grants and loans are also considered. As a rule, debts are not covered. The main welfare offices and welfare offices are responsible for war victims' welfare.

War victims' welfare is part of social compensation law. It is referred to as such because it is the largest group of beneficiaries, but it includes all welfare benefits under social compensation law. It is regulated in Sections 25 to 27j of the Federal Compensation Act and serves to supplement the other benefits of the Federal Compensation Act by providing special assistance in individual cases.

Therefore, a prerequisite for the granting of benefits is the recognition of an entitlement to benefits by the war victims' pension provider.

The benefits include benefits for participation in working life, sickness assistance, nursing care assistance, assistance for the maintenance of the household, assistance for the elderly, educational assistance, supplementary subsistence assistance, recreational assistance, housing assistance and assistance in special circumstances

Information:

The insurance office of the city of Worms is responsible for providing information and accepting applications in matters relating to statutory pension insurance if you live in Worms or are employed here.

We will of course help you to complete the application forms and forward your applications to the relevant pension insurance institutions.

Pension applications:

We recommend that you submit your application for an old-age pension 3 to 4 months before the desired pension start date.

The following documents are required:

  • Pension statement with insurance history
  • Bank details (BIC and IBAN number)
  • Tax identification number
  • Identity card or passport
  • Health insurance card
  • Severely disabled person's pass, if applicable
  • Address of the paying body for company pension, if applicable
  • Contract on partial retirement, if applicable
  • If applicable, proof of other entitlements (e.g. foreign pension, survivor's pension, accident pension)
  • Birth certificate of all children, if applicable

In the case of surviving dependants' pensions, death and marriage certificates and, if applicable, birth certificates of children entitled to orphans' pensions and the pension insurance number of the surviving dependant are also required.

In the case of a reduced earning capacity pension, additional information on the medical circumstances and professional career must be provided (such as details of illnesses, names and addresses of doctors providing treatment, hospital stays in recent years, name and address of last employer, employment history).

Due to the individuality of each case, a further list of possible documents must be omitted. Details will be discussed when the appointment is made.

Applications for account clarification:

Applications for account clarification are also accepted by us.

Individual insurance histories are often incomplete, as pension periods (e.g. child-raising periods, child allowance periods, training periods, periods of illness and unemployment, periods under the Foreign Pensions Act, insurance periods completed in the accession area and abroad, school periods) are not always automatically communicated to the pension provider.

In these cases, extensive account clarifications are often required, which we will be happy to help you with.

Miscellaneous:

The pension provider generally requires originals or certified copies as proof of periods of statutory pension insurance. We will certify pension insurance documents and life certificates for foreign insurance providers free of charge.

This means that certifications at the Citizens' Service are not necessary in matters of statutory pension insurance.
