Requesting access to files in fine proceedings
Source: BUS Rheinland-PfalzYou can inspect your case file at the Fines Office free of charge and in compliance with data protection regulations. You must apply for access to the file and you can do so without a time limit and informally at the authority keeping the file.
In German law, the fine procedure is a procedure for punishing (punishing) administrative offenses. The procedure is regulated in the Administrative Offenses Act (OWiG).
This applies here:
- General fine proceedings under special laws (except building law).
- Stationary and moving traffic for special cases.
The law on administrative offenses is intended to sanction misconduct against legal regulations.
The punishment of violations is intended as a deterrent, i.e. to prevent repetition (reminder character).
The initiation of fine proceedings is at the discretion of the authority (no obligation to prosecute as in criminal law).
The "general regulatory law" department processes all reports of administrative offenses with the exception of building law.
