Parental custody order if the child's welfare is at risk
Source: BUS Rheinland-PfalzIf the physical, emotional or mental well-being of a child is at risk and the custodial parents are not willing or able to stop this risk to the child's well-being, custody can be intervened in.
This always requires a family court decision.
In the event of an intervention in custody, only those areas of parental custody may be withdrawn that are necessary for the development of the child's welfare.
If parts of custody are withdrawn, a guardian is appointed for these areas. If custody is withdrawn altogether, the child is assigned a guardian.
" Section 4 of the Federal Child Protection Act (KKG ) requires professionals from certain professional groups (from healthcare, schools, advice centers, etc.) with a duty of confidentiality to work towards protecting the child if there are serious indications that the child's welfare may be at risk. Similarly, Section 8a SGB VIII regulates the procedure for professionals and employees of independent and public youth welfare services. An essential procedural step in both procedural regulations is to seek advice from an experienced professional. The term InsoFa counseling has become established for this in Worms and RLP. But also
Persons who are in professional contact with children or young people are also entitled to advice from a specialist with experience in this area to assess whether there is a risk to the welfare of the child in accordance with Section 8b of the German Child and Youth Protection Act (SGB VIII - KJSG).
The experienced specialist advises youth welfare professionals and other professions on the implementation of their protection mandate and provides information on possible help for the child and their family. The experienced professional therefore does not carry out any specific casework with the client and has no diagnostic tasks with client contact. In addition to managing the process, the experienced specialist offers supportive advice in order to reduce possible uncertainties and excessive demands and the resulting misjudgements on the part of the specialist responsible for the case or the specialist team.
The main task of the experienced specialist is to advise other professionals
- in the examination of significant indications
- assessing the risk of danger
- with regard to the question of whether the current or intended assistance is sufficient to safeguard the child's welfare
- on strategies for conducting discussions and ways of motivating parents and, if necessary, on the need to involve the youth welfare office.
Procedure
Counseling can be requested by facilities and services within the city of Worms from all providers. We will then send you an appointment as soon as possible.
- The consultation is free of charge.
- The consultation is anonymous. The specialist bringing in the case remains responsible for the case in every respect, even when the experienced specialist is involved
- In preparation for the consultation, all important information is documented anonymously in a case inquiry form and forwarded to the experienced specialist. This form can be requested directly from the providers or accessed via the specialist portal of the Early Help database at www.fruehe-hilfen-worms.de.
