Public procurement - participate in a restricted invitation to tender or restricted procedure

Find out about competitions in the tender media. If you would like to take part, submit an application for participation in the competition to the awarding authority.

The awarding authority will evaluate the applications. If the awarding authority has selected you, it will ask you to submit a tender. It will send you the tender documents.

You must sign the processed tender documents and send them to the awarding authority. The tender documents will tell you whether you can or must submit the documents electronically.

Apart from a few exceptions, you will be awarded the contract in writing. The award of the contract is also deemed to be the conclusion of the contract.

When preparing your tender, you must observe various formal and content-related requirements, for example

• the legally binding signature of the tender,
• the deadline for submission must be met,
• the complete entry of the requested prices.
• the complete declarations and evidence required by the client.

Attention: You may not change the contract documents!

You must sign and return the processed tender documents to the awarding authority. The tender documents will tell you whether you can or must submit the documents electronically. If this is the case, you must provide them with an electronic signature and transmit the data in encrypted form.

The awarding authority opens the tenders after the tender deadline has expired. It will examine tenders that have been received correctly and on time according to the following criteria

• Completeness,
• technical correctness and
• computational accuracy.

Apart from a few exceptions, you will be awarded the contract in writing. The award is also deemed to be the conclusion of a contract. The awarding authority will also inform you if you are not awarded the contract. The award will be made public.

The awarding authority.

A restricted invitation to tender or a restricted procedure is only possible under certain conditions, for example in the following cases:

• For construction services, certain value limits are not exceeded (national).
• Due to special requirements, only a certain group of contractors can provide the service.
• A public invitation to tender would cause disproportionately high costs for the contracting authority or the applicant companies.
• A public invitation to tender that has already been carried out has not led to an acceptable or economical result.
• A public invitation to tender is inappropriate for reasons of urgency or confidentiality, for example.

The tender documents will tell you which documents, samples or specimens you must enclose with your request to participate and tender.

Costs incurred by you for processing the offer will not be reimbursed.

Exception: The client requires the preparation of drafts, plans, drawings, calculations or other documents. In this case, the client must reimburse reasonable costs to all applicants.

You will be informed in the tender documents by when the contract will be awarded.
