Notarization by the guardianship authority
Source: Serviceportal Rheinland-PfalzPublic certification of your signature can increase the acceptance of a power of attorney you have granted. You can have your health care proxy and your care directive publicly notarized by the local care authority or a notary.
Public certification is required if the authorized representative is to make declarations to the land registry and their power of attorney has not already been certified by a notary. A publicly notarized power of attorney is also required if you wish to declare an inheritance in your name - for example due to over-indebtedness of the estate. The notarization of the signature under the power of attorney is also required if the authorized representative is to be entitled to register or deregister you with the registration office.
Notarization is required if the power of attorney is also to irrevocably authorize the purchase or sale of land or apartments.
If the power of attorney is also to entitle the holder to take out consumer loans, notarization is also recommended.
Tip: Involve a notary in complicated legal matters and seek legal advice if necessary.
The guardianship authority is the point of contact for all issues relating to legal guardianship. The Betreuungsbehördengesetz (BtBG) provides the basis for the work of the Betreuungsbehörde.
The main tasks of the care authority include
? supporting the guardianship court by providing an expert opinion on the need for guardianship and suggesting suitable guardians
? advising, assisting and supporting persons under guardianship, authorized representatives, voluntary guardians and professional guardians
? advice and identification of assistance that can prevent guardianship
? education and information on health care proxies, care and living wills
? checking the suitability of people who want to take on the role of professional guardian
? support with court placements
? cooperation with local care associations and institutions that support the group of people to be cared for
