Source: BUS Rheinland-PfalzA business registration is always necessary when you start a standing business. This is the case for
- New establishment of a business,
- New establishment of a branch office,
- New establishment of a dependent branch office,
- Takeover of an existing business, e.g. by purchase or lease,
- conversion of a sole proprietorship into another legal form,
- transfer of a business from the area of one authority to the area of another authority (considered as an abandonment by one authority and as a new establishment by the other authority).
The business registration must be carried out simultaneously with the start of the business.
- The obligation to notify exists only if it is a commercial activity. Excluded from the obligation to notify are the activities specified in § 6 paragraph 1 sentence 1 GewO.
Excluded are, among others:
- Primary production (cattle breeding, agriculture, hunting, forestry and fishing)
- Liberal professions (including lawyers, notaries, tax consultants, auditors, doctors, scientific, artistic and literary activities)
- Education of children for remuneration
- Education
The purpose of registering a trade is to enable the competent authority to monitor the exercise of the trade and to conduct statistical surveys.
The service is now provided in the Stadthaus Kaiserstraße, Kreyßigflügel.
Despite the freedom of trade, in Germany every commencement of self-employed activity is subject to notification.
The start of self-employment in the following trades is subject to notification:
Taking over an existing business
a branch or
a dependent branch
of a business located in Mainz.
Activity to be registered
When registering a business, all activities that you wish to carry out must be stated precisely.
For example: "Distribution of textiles" can be registered in this way. "Trade in goods of all kinds" must be defined and described more precisely.
The business registration is independent of whether the activity is carried out on a full-time or part-time basis. Furthermore, the amount of profit is irrelevant.
The business must be registered immediately at the time the business is established. A fine may be imposed if the registration is delayed or omitted.
The trade does not include
Prohibited activities
Primary production, e.g. agriculture and forestry
Liberal professions, e.g. doctors, tax consultants, lawyers
The trade must be registered with the trade registration office in writing using a form sent by post or by email to the email address below. The form can be found as a PDF file at the end of this website.
Please note: in the case of an OHG or GbR, each partner must submit a business registration.
