Apply for certificate of seclusion according to the Condominium Act
Source: Serviceportal Rheinland-PfalzThe certificate of completion certifies that apartments or other rooms are self-contained within the meaning of the German Condominium Act. In addition to the partition plan, it is required for the entry of the ownership shares in the land register.
The application for the issue of the certificate of completion must be submitted to the locally responsible lower building supervisory authority.
The procedure is regulated nationwide by the General Administrative Regulation for the Issuance of Certificates under the German Condominium Act (AVA).
To the competent lower building supervisory authority, i.e. the district administration, in independent and large towns belonging to the district the municipal administration or the association of municipalities if it has been assigned building supervisory tasks (Diez and Konz association of municipalities).
If condominium ownership is to be established through the contractual granting of special ownership (Section 3 of the German Condominium Act - WEG) or through division (Section 8 WEG), a certificate stating that the requirements of Section 3 (3) are met is one of the required documents. This certificate is called a "Abgeschlossenheitsbescheinigung" and is issued if the apartments or other rooms are self-contained and parking spaces and parts of the property located outside the building are defined by dimensions in the partition plan (§ 3 WEG).A certificate that the apartment is self-contained is also required for the creation of a permanent residential right (§ 32 WEG).
Apartments and rooms not used for residential purposes are self-contained if they are
- are structurally completely separated from other apartments and rooms (e.g. by walls and ceilings) and
- have their own lockable access directly from the outside, from a stairwell or a vestibule; the access must not lead via another separate property or via a neighboring property without real security.
A self-contained apartment or self-contained rooms that are not used for residential purposes may include additional lockable rooms outside the respective closure.
Construction drawing (floor plans, sections, views) in at least duplicate (at least on a scale of 1:100), which shows in particular how the common and special property are located in relation to each other and are separated from each other, and that the apartments or other rooms are self-contained. All individual rooms belonging to the same condominium etc. must be given the same number in the construction drawing.
Per separate property, permanent right of residence or permanent right of use: 15 to 150 euros.
