Right of residence under Community law for au pairs from EU member states

Citizens of a member state of the European Union as well as Iceland, Liechtenstein, Norway and Switzerland are not subject to any restrictions regarding taking up gainful employment.
Exception: Citizens of the new EU member state Croatia require an EU work permit from the Employment Agency in order to work as an au pair. This regulation initially applies during a transitional phase until June 30, 2015, after which they are not subject to any restrictions regarding taking up gainful employment, just like the other EU states.
Non-EU citizens:
Au pair employees who are not citizens of a member state of the European Union (EU member states) or of Iceland, Liechtenstein, Norway or Switzerland must apply for a residence permit for the purpose of au pair employment after entering the country before their national visa expires.
Au pairs who are citizens of Australia, Israel, Japan, Canada, the Republic of Korea, New Zealand and the United States of America can enter the country without a visa, regardless of the purpose and duration of their stay. They must apply for a residence permit within three months of entering Germany at the immigration authority responsible for their place of residence. However, if you are a national of one of the above-mentioned countries, you should contact the German diplomatic mission abroad to find out whether it is advisable to enter the country with a visa for au pair employment despite the fact that a visa is generally not required.
The residence permit for au pair employment applies to
- working in the household of the host family and
- childcare
The responsibility lies with the foreigners authority of the district administration and the municipal administration of the independent cities.
- For au pair employees:
- They are between 18 and under 25 years of age. For nationals from the new EU member states (Bulgaria, Estonia, Croatia, Latvia, Lithuania, Poland, Romania, Slovakia, Slovenia, Czech Republic and Hungary), the minimum age is 17 years. Minors require a written declaration of consent from their parents or legal guardians.

- a valid national "visa for au pair employees" (not required for EU citizens),
- a signed au pair contract (minimum 6 months, maximum 1 year) and
- health insurance.

- For host families:
- The host family speaks German as their mother tongue.
- The employment agency has approved the employment, if necessary

Note: You can only be exempted from the fees in exceptional cases.
You must apply for a residence permit for the purpose of working as an au pair at the relevant office before your entry visa expires.
If you have entered Germany without a visa, you must apply for a residence permit for the purpose of working as an au pair within three months of entering the country. You may only work as an au pair after a residence permit for au pair employment has been issued.
