The construction, modification, change of use and demolition of structural installations (e.g. buildings) require planning permission. However, this only applies if the Rhineland-Palatinate state building regulations do not stipulate otherwise, such as in the catalog of projects that do not require a building permit, in the exemption procedure and projects that are not subject to building supervision.

A building permit must be granted if the project does not conflict with any building or other public law regulations. The application for a building permit (building application) must be submitted to the municipal administration or the association municipal administration.

Which building documents must be submitted with the building application is determined in particular by the state ordinance on building documents and the building inspection. The building application and the building documents must be signed by the client and the author of the design, who is authorized to submit building designs for building applications.

The building permit is valid for four years. This period can be extended upon application. The application must be received before the deadline expires.

Note on demolition, conversion and renovation:

It is expressly pointed out that Section 24 (3) of the State Nature Conservation Act must be observed during construction, renovation or demolition measures. This means that species protection concerns in accordance with Section 44 (1) of the Federal Nature Conservation Act must be observed during construction, renovation or demolition measures. Structures that can be expected to serve as breeding or resting sites for particularly protected animal species must be examined accordingly for the presence of protected species. This is particularly the case for (older) masonry and buildings in outdoor areas. If occurrences are found, the lower nature conservation authority must be contacted in good time before the start of construction, renovation or demolition work to discuss the next steps.
