Soil extraction permit
Source: BUS Rheinland-PfalzThe approval requirement under nature conservation law for soil excavations is based on the impact regulation of the Rhineland-Palatinate Nature Conservation Act (LNatSchG).
The following, for example, are subject to approval
- independent excavations of banks and wetlands,
- dependent excavations from a height or depth of two meters or with a base area of more than 300 m2;
- the extraction or excavation of mineral resources.
The Rhineland-Palatinate State Building Regulations (LBauO) must also be observed, as the above excavations are usually also classified as measures requiring planning permission.
The excavation may also require a permit under water law in accordance with the Water Resources Act (WHG) if it is likely to cause permanent or not insignificant harmful changes to the water quality. Commercial extraction of soil components always requires a permit under water law in accordance with the State Water Act (LWG).
Nature conservation concerns are also taken into account in a building permit or a permit under water law.
