Land Sale Request Permit
Source: BUS Rheinland-PfalzYou would like to legally transfer ownership, rights or claims to your moorland and wasteland property or to your agricultural and/or forestry land to third parties. Then you need a permit for this.
This will be required when transferring:
- a co-ownership interest in one of the said plots of land;
- a share of the inheritance to another person other than a co-heir if the estate consists essentially of an agricultural or forestry holding;
- the rights of use of a piece of land.
Please contact the district administration or the city administration in independent cities as the lower agricultural authority.
Responsibility lies with the lower agricultural authority.
An authorisation may be refused or restricted by obligations or conditions only if:
- the transfer of ownership means an unhealthy distribution of land, or
- the transfer would uneconomically reduce or divide the immovable property or a majority of immovable property which is geographically or economically connected and belongs to the transferor, or
- the equivalent value is grossly disproportionate to the value of the property.
An unhealthy distribution of land usually occurs when the land is to be sold to non-farmers and there are farmers who are interested in buying and dependent on the purchase.
The sale of a plot of land in Rhineland-Palatinate does not require a permit under the Real Estate Transactions Act if:
- if the land is not larger than 50 ares, unless:
- the property is used for viticulture and is larger than 10 ares or
- on the property there is the farm of an agricultural or forestry business.
Contract of sale or draft of the contract of sale.

The decision on approval will be taken within one month of receipt of the application.
You can appeal against the decision of the Lower Agricultural Authority.
A written application is required. This can only be made by the respective contracting parties or those for whose benefit the contract has been concluded. If the contract has been authenticated by a notary, the notary is deemed to be authorised to apply for authorisation.
If no permit is required for the sale, you will receive a written notification from the licensing authority.
