Applying for registration of a professional practice company in the professional register for tax advisors

The Rhineland-Palatinate Chamber of Tax Consultants is responsible for professional practice companies based in Rhineland-Palatinate.

If professional practice companies are recognized in the registration district or if they relocate their registered office to the registration district, they are entered in the professional register for tax advisors.

The following must be entered

• the name or company name and the legal form,
• the date of recognition as a professional practice and the name of the authority or Chamber of Tax Consultants that granted the recognition,
• the authorization to use the designation "Landwirtschaftliche Buchstelle",
• the address of the professional establishment, the business telecommunications data, including the e-mail address, and the business Internet address,
• professional associations within the meaning of Sections 49, 50 and 55h,
• The following information on the shareholders:
  • for natural persons: the surname, first name or first names and the profession practiced in the professional association,
  • in the case of legal entities and partnerships with legal capacity: their name or company name, their registered office and, if required by law, the register responsible for them and the register number,
  • for legal entities: the surname, first name or first names and profession of each member of the body appointed to legally represent them,
  • in the case of partnerships with legal capacity: the surname, first name or first names and profession of the partners authorized to represent the company,
  • the surname, first name or first names and profession of the employed tax consultants, tax agents, lawyers, auditors and sworn accountants who are authorized to represent the professional practice company, provided that the professional practice company applies for entry in the professional register,
  • the address of the other advisory offices, the surname, first name or first names and the address of the persons managing the other advisory offices,
  • the surname, first name or first names and address of the representative or authorized agent, if one has been appointed or nominated
  • the existence of a prohibition on practicing or representing within the meaning of section 90 (2) no. 4 or section 134,
  • the name of the special electronic tax consultant mailbox of the professional practice firm and
  • all changes to the information in letters a and c to m.

Note: Not only transfers to a specific register district are subject to notification, but also transfers from a register district. This must be reported to the relevant Chamber of Tax Consultants.

In principle, an informal notification is sufficient.

However, the Chamber of Tax Consultants may require the submission of suitable evidence.

There are no fees.

Notifications regarding entries in the professional register must be made without delay. Timely notification ensures that the professional register kept by the Rhineland-Palatinate Chamber of Tax Consultants is always up to date.

Special feature for the professional practice company: Irrespective of the above-mentioned obligation to notify changes, a declaration in accordance with § 76e of the Tax Consultancy Act (StBerG) must be submitted in January of each calendar year.

The Federal Chamber of Tax Consultants (BStBK) maintains an electronic directory of all members of the chambers of tax consultants in accordance with the Tax Consultancy Act. This directory of tax advisors is used to provide information to authorities and courts, persons seeking legal advice and other parties involved in legal transactions. The chambers of tax advisors enter the data stored in the professional register into the directory maintained by the Federal Chamber of Tax Advisors using an automated procedure. Anyone is entitled to retrieve individual data from the register free of charge.
