Deletion of a building encumbrance from the building encumbrance register

The building obligation is deleted by written waiver of the building supervisory authority. This authority will declare the waiver if there is no longer a public interest in the building obligation. The building supervisory authority can declare the waiver either on its own initiative or on the basis of your application.

The lower building supervisory authority is responsible for deleting a building charge. This is the district administration, in independent and large towns belonging to the district, the municipal administration or the association municipality administration if it has been assigned building supervision tasks (Diez and Konz association municipality administrations).

The waiver of a building obligation is declared by the building supervisory authority if there is no longer a public interest in the building obligation.

If you wish to apply for the deletion of a building obligation, your application must contain the details of the building obligation and a justification as to why the public interest no longer exists.

The deletion of a building charge is subject to a fee. The amount of the fee is set out in the State Ordinance on Fees and Remuneration for Official Acts and Services under Building Regulations Law (Special List of Fees).

There are no time limits for the deletion procedure.

For disputes in connection with building charges, you can generally lodge an objection and then take legal action.

There is no nationally introduced form. If necessary, the local building supervisory authorities may have forms available to help you with your application.
