If you are the client or have been given responsibility for a construction site, you must, under certain conditions, send an advance notice to the relevant health and safety authority at least 2 weeks before the construction site is set up. You must send advance notice if

  • the expected duration of the work is more than 30 working days and more than 20 employees will be working on the construction site at the same time (i.e. over a period of at least one shift) or
  • the scope of your construction work is expected to exceed 500 person-days (whereby one person-day comprises the work of one person over one shift).

Setting up the construction site begins with the essential preparatory work at the site of the construction project that is required immediately before it is carried out. This includes, for example

  • Installation of social facilities: for example toilets, break rooms or washrooms,
  • Installation of supply and disposal facilities,
  • delivery of building materials, machinery and equipment.

You must also post the advance notice on the construction site on the first day of the construction site at the latest. Please note that

  • the advance notice is clearly visible,
  • the advance notice remains legible and unaffected by external influences and weather conditions,
  • the advance notice is updated if there are significant changes. It is not necessary to resubmit it to the competent health and safety authority.

Significant changes that require the advance notice to be updated include, for example

  • Clients or commissioned third parties change,
  • Coordinator is newly appointed or changes,
  • the duration of the construction work is shortened, which means that more work has to be carried out simultaneously or in unplanned shifts
  • employees of several employers or subcontractors are working on the construction site at the same time for the first time,
  • the number of people working on the construction site at the same time or the number of employers or companies without employees increases significantly.

As the building owner, you or a third party commissioned by you must give advance notice to the competent occupational health and safety authority at least 2 weeks before setting up each construction site if

  • the expected duration of the work is more than 30 working days and more than 20 employees will be working on the construction site at the same time (i.e. over a period of at least one shift) or
  • the scope of your construction work is expected to exceed 500 person-days (where one person-day comprises the work of one person over one shift).

Minimum details of the advance notice:

  • Location of the construction site,
  • Name and address of the client or building owner,
  • Type of construction project,
  • Name and address of the third party responsible instead of the client,
  • name and address of the coordinator,
  • expected start and expected duration of the work,
  • expected maximum number of employees on the construction site,
  • Number of employers and contractors without employees who are expected to work on the construction site,
  • details of the employers and contractors without employees already selected.

The conditions are

  • Visible posting of the advance notice on the construction site
  • Adaptation of the notice in the event of significant changes without resubmission.

Struktur- und Genehmigungsdirektion Nord

Aufgaben der Struktur- und Genehmigungsdirektion Nord:

Seit Januar 2000 gewährleistet die SGD Nord als obere Landesbehörde die Durchführung von qualifizierten Genehmigungsverfahren für Unternehmen und Kommunen aus den Regionen Mittelrhein und Trier. Zusammen mit der damit einhergehenden wirtschaftlichen Entwicklung von Rheinland-Pfalz stehen die Überwachung der gewerberechtlichen Bestimmungen, der Boden-, Gewässer- und Naturschutz - und somit das Leben der Menschen in einer gesunden Umwelt - im Vordergrund der Arbeit der SGD Nord, die sich in folgende Aufgabenbereiche gliedert:

Gewerbeaufsicht

Der Gewerbeaufsicht obliegen insbesondere die Aufgaben des technischen und sozialen Arbeitsschutzes, des Immissionsschutzes (Luftreinhaltung, Lärm, Erschütterungen), der Anlagensicherheit, des Schutzes vor Chemikalien, biologischen Arbeitsstoffen und gentechnisch veränderten Organismen, des Strahlenschutzes sowie des technischen Verbraucherschutzes. Sie wird präventiv durch Beratung, überwachend durch Betriebsrevisionen und nachsorgend tätig.

Wasserwirtschaft, Abfallwirtschaft, Bodenschutz

Die Aufgaben bestehen insbesondere in der Durchführung von umweltrechtlichen Genehmigungsverfahren für Maßnahmen an Gewässern, Hochwasserschutz-, Wasserversorgungs-, Abwasser- und Abfallanlagen. Die SGD Nord weist durch Rechtsverordnung Wasserschutz- und Überschwemmungsgebiete aus. Darüber hinaus ist sie auch für die Sanierung von Altlasten zuständig. Als obere Fischereibehörde nimmt sie Aufgaben der Fischereiaufsicht sowie des Fischartenschutzes wahr. Zudem sind die Hochwassermeldezentren Mosel und Nahe-Lahn-Sieg hier angesiedelt.

Raumordnung, Naturschutz, Bauwesen

Aufgabe der Abteilung ist es, die Belange der Raumordnung, des Naturschutzes und der baulich-städtebaulichen Entwicklung im Rahmen von Beteiligungs- oder Genehmigungsverfahren mit den räumlichen und rechtlichen Gegebenheiten auf ihre Umsetzbarkeit hin abzustimmen. Als obere Landesplanungs-, Naturschutz- und Bauaufsichtsbehörde wirkt die SGD Nord darauf hin, dass die Anwendung des geltenden Rechts, trotz unterschiedlicher örtlicher Zuständigkeiten, möglichst einheitlich erfolgt, um das Verwaltungshandeln für Bürgerinnen und Bürger berechenbar und transparent zu machen. Im Rahmen der „Baukulturinitiative für das Welterbe Oberes Mittelrheintal“ werden Projekte und Initiativen zur Förderung der Baukultur im Welterbegebiet vorbereitet und umgesetzt. Ferner obliegt der SGD Nord die Durchführung von Besitzeinweisungs- und Enteignungsverfahren sowie von Entschädigungsverfahren.

Welterbe Oberes Mittelrheintal

Das Aufgabengebiet der Projektgruppe ergibt sich aus dem Managementplan für das Welterbe Oberes Mittelrheintal. Dort sind die wesentlichen, von der UNESCO anerkannten Zielvorgaben für den Fortbestand und die Weiterentwicklung dieser Kulturlandschaft genannt. Die Projektgruppe unterstützt die Arbeit von Frau Präsidentin Dagmar Barzen, der Bevollmächtigten für die Umsetzung des Managementplans, und übernimmt dabei u.a. Koordinierungs- und Informationsaufgaben bezüglich aller Planungen und Projekte, die sich auf das Welterbegebiet auswirken können.

Einheitlicher Ansprechpartner

Die SGD Nord hat ab dem 28. Dezember 2009 die Aufgabe des Einheitlichen Ansprechpartners (EAP) nach der EU-Dienstleistungsrichtlinie und steht allen Unternehmen und Existenzgründern unterstützend zu Seite. Der EAP informiert und berät über die Anforderungen, Verfahren und Modalitäten, die für die Aufnahme und Ausübung einer Dienstleistungstätigkeit benötigt werden. Er wickelt darüber hinaus auf Wunsch die Verfahren ab, die für die Aufnahme und Ausübung einer unternehmerischen Tätigkeit aufgrund Bundes- oder Landesrecht erforderlich sind. Die Abwicklungsmöglichkeit über den EAP ergibt sich im Einzelfall aus dem Fachrecht für Genehmigungen und Erlaubnisse, z.B. nach dem Gewerbe- und Handwerksrecht oder dem Landeswassergesetz. Die Inanspruchnahme des EAP ist kostenfrei.
